These Terms and Conditions ("Terms") govern your access to and use of the Fashify AI platform ("Platform") operated by NOTRINO RESEARCH BİLGİ TEKNOLOJİLERİ ARAŞTIRMA GELİŞTİRME LİMİTED ŞİRKETİ ("Fashify," "Company," "we," "us," or "our"). Please read these Terms carefully before using our Platform.

You agree to be bound by these Terms by accessing or using the Platform. If you disagree with all the Terms, please do not use the Platform.

By creating an account or using the Platform, you confirm that you are at least 18 years old and capable of entering into a legally binding agreement. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. DEFINITIONS

"Platform" refers to the Fashify AI platform, including the website, software, and all associated services.
"User," "you," or "your" refers to any individual or entity accessing or using the Platform.
"Content" includes all images, graphics, text, and other materials generated, uploaded, or otherwise made available through the Platform.
"Subscription" refers to the paid plans offering access to specific features of the Platform.

3. USER ACCOUNTS

3.1 Account Registration

To use certain features of the Platform, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to secure your account.

4. USE OF THE PLATFORM

4.1 Permitted Uses

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform in accordance with these Terms.

4.2 User Responsibilities

You agree not to:

Use the Platform for any unlawful purpose.
Upload or generate Content that is illegal, harmful, obscene, defamatory, or infringing on third-party rights.
Attempt to gain unauthorized access to the Platform or its related systems.
Reverse engineer, decompile or disassemble any part of the Platform.

4.3 Compliance with Laws

You agree to comply with all applicable laws and regulations in connection with your use of the Platform.

5. SERVICES

5.1 Service Description

Fashify provides an AI-powered platform that allows Users to generate high-quality fashion visuals by uploading garment images and customizing model features and backgrounds.

5.2 AI-Generated Content

While we strive to produce accurate and high-quality Content, you acknowledge that AI-generated images may occasionally produce unintended results. You are responsible for reviewing and approving all Content before using it.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Ownership by User

All intellectual property rights in the Content you upload and the AI-generated images created using your Content belong to you.

6.2 Ownership by Company

All rights, title, and interest in and to the Platform, including software, algorithms, and other underlying technology, are owned by the Company.

6.3 License to Use Content

By uploading Content to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process your Content solely for the purpose of providing the services.

7. PRIVACY AND DATA PROTECTION

7.1 Data Collection

We collect personal information such as email addresses, payment information, and usage data to provide and improve our services.

7.2 Data Usage

Your data is used to facilitate your use of the Platform, process payments, and enhance service features.

7.3 Data Storage and Security

We store your data on secure Amazon Web Services (AWS) cloud servers that comply with GDPR standards. We implement industry-standard security measures to protect your data.

7.4 Data Sharing

We do not share your personal data with third parties unless required by law.

8. FEES AND PAYMENT

8.1 Subscription Plans

We offer flexible subscription plans:

Starter Plan: $19/month for 100 credits
Pro Plan: $57/month for 500 credits
Business Plan: $114/month for 1,500 credits
Mega Plan: Custom pricing for large-scale operations

8.2 Payment Methods

Payments are processed through Iyzico, a PayU company. By subscribing, you authorize us to charge your payment method for the subscription fees.

8.3 Billing Cycle

Subscriptions are billed on a monthly basis. Your subscription will automatically renew unless canceled prior to the renewal date.

8.4 Refund Policy

If you are not satisfied, you may request a refund within the first 7 days of your initial subscription. To request a refund:

Refunds will be processed through Iyzico and credited back to your original payment method within 30 days.

9. CANCELLATION AND TERMINATION

9.1 Cancellation by User

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle.

9.2 Termination by Company

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or unlawful activities.

9.3 Effect of Termination

Upon termination, your access to the Platform will cease, and any unused credits will be forfeited.

10. DISCLAIMERS AND LIMITATIONS OF LIABILITY

10.1 Disclaimers

The Platform is provided on an "as is" and "as available" basis. We make no warranties regarding the accuracy, reliability, or suitability of the Platform for any purpose.

10.2 Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from:

Your use or inability to use the Platform.
Unauthorized access to or alteration of your transmissions or data.
Any other matter relating to the Platform.

10.3 Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, officers, agents, and employees from any claim or demand arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. GOVERNING LAW AND DISPUTE RESOLUTION

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey.

11.2 Dispute Resolution

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ankara, Turkey.

12. AMENDMENTS TO TERMS

12.1 Right to Modify

We may update these Terms from time to time. Any changes will be effective when posted on the Platform.

12.2 Notice of Changes

We will notify you of significant changes by email or through the Platform. Your continued use of the Platform after such notification constitutes acceptance of the revised Terms.

13. MISCELLANEOUS

13.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the Platform.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
