1. Introduction

The Fashify AI platform ("Platform") is operated by NOTRINO RESEARCH BİLGİ TEKNOLOJİLERİ ARAŞTIRMA GELİŞTİRME LİMİTED ŞİRKETİ ("Company"), Üniversiteler Mah. İhsan Doğramacı Blv. Arge ve Eğitim Merkezi No:13 Çankaya/Ankara, Turkey, [email protected].

By creating an account or using the Platform, you confirm that you are at least 18 years old and capable of entering binding agreements. If you use the Platform on behalf of an organization, you represent that you have authority to bind that entity.

2. Definitions

• Platform: the Fashify AI platform including website, software and services.
• User: any individual or entity accessing the Platform.
• Content: all images, graphics, text and other materials generated, uploaded or otherwise made available.
• Credits: prepaid units spent per generated output.

3. User accounts

You must provide accurate registration information and are responsible for the confidentiality of your credentials and all activity under your account. Notify us immediately of any unauthorized use; the Company is not liable for failures to secure your account.

4. Use of the Platform

You receive a limited, non-exclusive, non-transferable license to access and use the Platform in compliance with these Terms. You agree not to:

• use the Platform for unlawful purposes;
• upload or generate Content that is illegal, harmful, obscene, defamatory or infringing;
• attempt unauthorized access to the Platform or related systems;
• reverse engineer, decompile or disassemble any part of the Platform.

You agree to comply with all applicable laws and regulations.

5. Services

Fashify provides an AI-powered platform that allows Users to generate fashion visuals by uploading garment images. AI-generated images may occasionally produce unintended results; review generated Content before using it commercially.

6. Intellectual property

All intellectual property rights in the Content you upload and the AI-generated images created from your Content belong to you. All rights, title and interest in the Platform itself, including software and algorithms, belong to the Company. You grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce and process your Content solely to provide the service.

7. Privacy and data protection

Data handling is governed by the Privacy Policy. Your data is stored on secure Amazon Web Services (AWS) cloud servers complying with GDPR standards, and personal data is not shared with third parties unless required by law.

8. Fees and payment

The Platform sells prepaid credit packages. Current packages, prices and per-output credit costs are listed on the Pricing page. Prices exclude VAT unless stated otherwise. Payments are processed through iyzico, a PayU company.

Refunds may be requested within the first 7 days after the initial purchase by contacting [email protected], and are processed within 30 days to the original payment method. Credits already spent on completed generations are non-refundable; failed generations are refunded automatically as credits.

9. Cancellation and termination

You may close your account at any time through account settings. The Company may suspend or terminate accounts for violations of these Terms or fraudulent activity. Upon termination, access to the Platform ceases and unused credits are forfeited unless an enterprise agreement states otherwise.

10. Disclaimers and limitation of liability

The Platform is provided on an "as is" and "as available" basis without warranties regarding accuracy or suitability. The Company is not liable for indirect, incidental, special or consequential damages, including loss of profits, data or other intangible losses. You agree to indemnify and hold harmless the Company from claims arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

11. Governing law and disputes

These Terms are governed by the laws of Turkey. Disputes are subject to the exclusive jurisdiction of the courts of Ankara, Turkey.

12. Amendments

The Company may update these Terms; changes take effect upon posting. Significant changes are notified by email or on the Platform, and continued use constitutes acceptance.

13. Miscellaneous

These Terms together with the Privacy Policy constitute the entire agreement. If a provision is found invalid, the remaining provisions stay enforceable. Failure to enforce any right or provision does not constitute a waiver.
