Commercial Electronic Message Consent

This notice explains how and when NOTRINO RESEARCH BİLGİ TEKNOLOJİLERİ ARAŞTIRMA GELİŞTİRME LİMİTED ŞİRKETİ ("Fashify", the "Company") sends commercial electronic messages, the legal basis on which it does so, and the rights you hold to refuse or withdraw at any time. These messages are sent in accordance with the Law on the Regulation of Electronic Commerce No. 6563 (the "E-Commerce Law"), the Regulation on Commercial Communication and Commercial Electronic Messages, and the İleti Yönetim Sistemi (İYS) rules.

This notice should be read together with our Data Protection Notice (KVKK) and our Privacy Policy, which explain in detail how the personal data used to send these messages is processed and the rights you hold as a data subject.

1. Sender identity

The sender of any commercial electronic message under this notice is:

Fashify operates the marketing website fashify.studio and the application app.fashify.studio.

2. What messages and channels

With your consent, Fashify may send you commercial electronic messages (including promotions, campaigns, product updates and newsletters) via email and/or SMS. These are sent in accordance with the Law on the Regulation of Electronic Commerce No. 6563 ("E-Commerce Law"), the Regulation on Commercial Communication and Commercial Electronic Messages, and the İleti Yönetim Sistemi (İYS) rules.

3. Prior consent (onay) and permitted exceptions

We send commercial electronic messages only after obtaining your prior consent (onay), except in the narrow cases the E-Commerce Law and its Regulation expressly exempt from the consent requirement, for example messages strictly relating to the continuation, change, use, maintenance or after-sales of a transaction you have actually carried out with us. We do not rely on this exemption beyond what the law allows, and an opt-out facility is included in every such message. Your consent specifies the channels (email/SMS) and the content covered.

4. Registration in İYS

Your commercial-message consent and your opt-out (refusal) preferences are registered and managed through the İleti Yönetim Sistemi (İYS), the national message management system. You can view and manage your consents for Fashify at any time via İYS (iys.org.tr), in addition to the channels we provide.

5. Right to refuse / opt out (ret hakkı)

You have the right to refuse to receive commercial electronic messages, and to opt out, at any time and free of charge, without giving any reason. You can exercise this right by:

  • (i) using the unsubscribe/opt-out link or facility included in every message;
  • (ii) replying with the opt-out keyword indicated in SMS messages;
  • (iii) managing your preferences via İYS (iys.org.tr); or
  • (iv) emailing [email protected].

Once you opt out, we will stop sending commercial electronic messages within three (3) business days of receiving your request, as required by the Regulation on Commercial Communication and Commercial Electronic Messages.

Consumer reservation. Marketing consent is optional and separate: giving or refusing it is not a precondition of, and does not affect, your ability to purchase or use the Service. You can review our prepaid credit packages on the Pricing page.

6. KVKK basis and withdrawal of consent

The personal data used to send commercial electronic messages (e.g. your email address and phone number) is processed on the basis of your explicit consent under the KVKK and your consent (onay) under the E-Commerce Law and İYS rules. For details on how this data is processed, your rights, and how to exercise them, see our Data Protection Notice (KVKK) and Privacy Policy. Withdrawing your İYS consent stops further messages; it does not, by itself, delete other personal data we are required or entitled to retain.

Consumer reservation. Your consent is voluntary, separate from any purchase, and withdrawable at any time without affecting the lawfulness of processing carried out before withdrawal. Nothing in this notice limits or waives any mandatory statutory right you hold under the KVKK or under consumer-protection law.
